During the development of the Third Mexican Provincial Council (1585), the Bishop of Nueva Galicia submit for consideration of the consultants, theologians and canon lawyers, the case of a cleric who he doubts if incurred in excommunication, after having appealed and disobeyed an episcopal precept. Therefore, we analyzed the application of the rules then in force, applied by the consultants from the facts, theology and law, in the ambit of sixteenth century New Spain and the implementation of the Council of Trent.
