Abstract
In Kriminalitätsbereichen wie Organisierter Kriminalität, Terrorismus und Korruption spielt das Vermögen eine wichtige Rolle. Es stellt den Anreiz dazu dar, schwere Straftaten zu begehen, und es dient dazuhin zur Finanzierung dieser Delikte. Aus diesem Grund muss die staatliche Reaktion neben der Strafe auch vermögensrechtliche Folgen der Tat umfassen. Die Anwendung von vermögensrechtlichen Sanktionen wird sowohl im internationalen als auch im nationalen Recht erweitert. Die Entwicklung des Rechts verläuft dabei zweispurig: Einerseits werden Vermögensabschöpfungsmaßnahmen gegen Organisierte Kriminalität und Korruption eingeführt, bei denen die Anforderungen an den Nachweis der kriminellen Herkunft des Vermögens reduziert sind. Andererseits – und dies hat sich aus der Bekämpfung der Terrorismusfinanzierung entwickelt – setzt man verstärkt auf den Ausbau präventiver Instrumente.
Die Arbeit beschäftigt sich mit dieser Entwicklung aus rechtsvergleichender Perspektive. Vor dem Hintergrund des internationalen Rechts untersucht sie die Vermögensabschöpfungsregelungen im deutschen und polnischen Straf- und Ordnungswidrigkeitenrecht. In vielen Fällen wird den Vermögensabschöpfungsmaßnahmen in beiden Rechtsordnungen kein Strafcharakter zugeschrieben. Da es sich aber häufig um schwere Eingriffe in das Eigentumsrecht handelt, ist das Ziel des Vergleichs zu untersuchen, an welcher Stelle der Wunsch der Strafverfolgungsbehörden nach einer effektiven Vermögensabschöpfung auf eine verfassungsrechtliche Grenze trifft.
Asset forfeiture has become an important tool of both crime prevention and con-
trol. In areas of crime such as organized crime or corruption financial gain is a crucial
incentive to commit an offence. For this reason, an adequate response to those crimes must also address the financial aspect and deprive the offender of his or her financial gain. For areas of crime such as terrorism, financial assets are a tool that facilitates those offences. Here, asset forfeiture represents a measure to prevent criminal activity. These two applications of asset forfeiture can be observed both in international and national law. To make asset forfeiture an effective law enforcement tool, several changes have been introduced concerning requirements for criminal evidence and burden of proof. On the one hand, the requirements for proving a link between an asset and an offence have been reduced. On the other hand, under certain circumstances a person concerned must prove the legal origin of his or her assets.
This study deals with the development of asset forfeiture regulations from the perspective of comparative law. The analysis begins with the requirements established under international law and takes them as a background for changes implemented in the national laws of Germany and Poland. The central part of the study consists of an analysis of asset forfeiture regulations in criminal law and administrative offences law in both legal systems. It is demonstrated that asset forfeiture is in many cases not considered a punishment or even a penal measure. This fact, in combination with a reduced standard of proof or a reversed burden of proof, weakens the protection of property. At the same time these same features of asset forfeiture are presented as necessary for effective crime prevention and control. The aim of the study is to examine the constitutional limits of the asset forfeiture regulations currently in force.
Pursuing this goal from the comparative law perspective allows to concentrate not
on the legal regulations but on the actual problem to be solved by these regulations.
The study perceives asset forfeiture as a response to the needs of an effective financial sanctions system, allowing law enforcement to deprive criminals of their ill-
gotten gains and preventing further crimes. This regulatory system must respect the
protection of property guaranteed under the rule of law, hence the question about the
extent of forfeiture both in terms of effectiveness and accordance with the rule of law.
